  • Contact Information: Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. DMCA Takedown and Review Timeline

Devourlife takes copyright protection seriously. Once an infringement notice containing all valid parameters is submitted to our legal desk, it undergoes a structured review matrix before a resolution is finalized:

3. Counter-Notification Procedures

If material you authored or supplied was removed from our digital storefront by mistake or misidentification, you may submit a formal Counter-Notification in compliance with 17 U.S.C. § 512(g)(3). Your written counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Upon receipt of a valid counter-notice, Devourlife will promptly forward a copy to the original complaining party. If the copyright owner does not file a lawsuit seeking a court order within 10 to 14 business days, we are legally permitted—and required—to restore the disabled material to our platform.

4. Under Penalty of Perjury: Civil and Financial Liability

Legal Risk Disclosure (17 U.S.C. § 512(f)): Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to severe civil liability. This includes financial damages, court overheads, and attorney fees incurred by Devourlife, any copyright owner, or any innocent store merchant who suffers harm due to a fraudulent or malicious takedown notice. 5. Policy Regarding Repeat Infringers

If any vendor, independent digital asset contributor, or staff member is repeatedly flagged for uploading copyrighted or unlicensed promotional assets without valid written authorization, their privileges, partner accounts, and operational contracts within our e-commerce framework will be terminated immediately and permanently.
